Smile amending 2008 return

When I originally purchased my home in 1998 I was single and the only person on the deed . I married in 2000 and then refinanced the property in December of 2008 . At that time my husband was working full time and I part time . He was put on the loan at that time as the primary . Was he eligible for the first time home buyers credit ? He has never owned any property until being added to this loan while doing the refinance . Thanks for any help .

"---> The law defines “first-time home buyer” as a buyer who has not owned a principal residence during the three-year period( The federal government defines first-time homebuyer as someone who has not owned a home for the past three years (36 months) prior to the purchase. So, as your spouse have not owned a home in the past three years but you have owned a principal residence, neither you nor your spouse qualifies for the first-time home buyer tax credit.
