earned income credit help

I need some help about claiming my child as EIC. I get her every other weekend & 1 nite a week. I pay child support monthly. Her mother hasn't worked in 2-3 years. When I asked her if i could claim our child, she told me her mother claimed her. She doesn't live with her mother & neither does my child. So my question is can i claim my child as EIC (not a dependent)? Would it be worth the argument? Or not?

I need some more background info ; as you know, to cliam EIC, you must file your return jointly. MFS taxpayers are not eligible to EIC
2011 Earned Income Tax Credit (EITC) - Can I Claim It?
