earned income credit help

Hi. Just a question about who gets to claim what..
I have a child that I get every other weekend & 1 nite each week. I pay child support monthly. Her mother doesn't work & hasn't in 2-3 years. I asked if i could claim our child & she said her mother does. So my question is can I claim my child on earned income credit (not as a dependent) would it be worth the argument or not?
