Incorrect SSN on 1099, what do I do?

I do some freelance writing for an online content company. When I received my 1099, it came with my name on it but has my husband's SSN listed (I must have mistakenly filled in his number instead of mine when I signed up with the site.) I have been trying to get the company to send me an amended 1099 but I have had no luck getting one. They have responded to my request by saying that their accounting team is working on it. That was weeks ago. I keep trying to get an update on where they are in the process, but they refuse to answer me. My question is whether or not I can file my taxes now even though this mistake exists. It doesn't affect my earnings at all. That part was correct. It just probably appears to the IRS as though my husband made the money instead of me (it was only $300). What should I do? I really want to file my taxes now. Any advice would be greatly appreciated!

I would urge you to file your tax return including the $300 income that was reported on the 1099-Misc despite the fact that the SSN was incorrectly stated. I would simply not worry about the incorrect SSN on the 1099-Misc, and simply include this amount as Miscellaneous Income subject to S/E tax!

This error is not unusual and occurs quite frequently, so do not panic, again, the amount is very small! Go ahead and file your return including this amount, and don't worry the IRS will not penalize you in any way!
