Will the First Time Home Buyers Credit differ based on taxpayers filing status?

Actually the First Time Home Buyers Tax Credit is in general equal to $7,500 for a qualified home purchase, whether or not the qualified home buyer files his or her taxes either as a single filing status or married filing joint status..

But, the IRS states that "if a household files their taxes as "married filing separately" (in effect, filing two returns), then the credit of $7,500 is claimed as a $3,750 credit on each of the two returns."

Married Couple...one owned home previously

Hello...

I bought a house in 2005. I got married in 2006 and never put my husband's name on the house. We bought a house together in September of 2008 and tried to sell my house for several months. As of January 2009 I no longer own the house due to forclosure. Since my husband is a first time home buyer but I am not...does he qualify for the credit?
