Need help to identify my status - resident or non-resident alien ?

Hi,

I am an Indian Citizen. I work in US under L1 Visa.
I was in US from 11-Nov-2008 to 3-Mar-2012. Then I returned to India. I came back to US in 06-Sep-2013 with my wife. She is in dependent (L2) visa and not working.


1. Can you please help me to identify my status - alien or non-resident alien ?
2. Do i need to file the tax as married and filing jointly ?
3. Do i need to file with the status as resident alien ?

#3;yes. The benefit of filing taxes after you met the SPT is, that you can claim being a resident for the time you were in the US. That allows you to claim your kid if you have which you could not do as a non-resident alien. You would also be able to claim more deductions (itemized) than as a non-resident alien.
