S-Corporation to Schedule C

My accountant filed as an S-corporation for tax year 2012. This was her recommendation. I am a sole owner with 1 part-time employee. I did some research and have found that filing with a Schedule C on my personal return would be in my best interest. Can I file with a Schedule C instead of an S-corporation for 2013? Can I file an amended return for 2012 and file with a Schedule C? If so, do I need to dissolve the S-corporation and get a new EIN?

#1;As an S-corp, not sole proprietorship, you must file 1120S,NOT Sch C ; 1120s will attribute things to you personally that can require that you also file a sch C.filing 1120S is not optional. Sch C is required by the IRS for individuals carrying on business as a sole proprietor / an independent contractor.



#2;Noyou can’t file an amended return of 1120Sfor 2012 and file with a Schedule C converting the S corp back to a SP P is a complex processwith significant tax implications;you need to Switch the S Corp to Sole Proprietor by completing the Articles of Dissolution form and 996 ;u need to liquidate the S corp. you also need to file the final income tax return on form 1120S. Your old business license, if it was in the name of your S Corp, is invalid. You cannot use the S corp EIN as a sole proprietor.you need to get a new EIN from IRS.
