Tax filing as single, not legally married

Hello,

My husband and I share health insurance provided by my employer. He is listed as a spouse on my health insurance , but on my W4 - I am single .
We did not marry legally in the USA , but had a traditional Indian marriage in India.
Can we file as single or do we have to file as a married?
