When are Non Resident Aliens required to file a Tax Return?

Per the IRS, "an alien is any individual who is not a U.S. citizen or U.S. national", and a "nonresident alien is an alien who has not passed the green card test or the substantial presence test." The IRS has stated that if a Non Resident Alien (person) is any of the following, then they are required to to file a US Tax Return:
  1. A nonresident alien individual engaged or considered to be engaged in a trade or business in the United States during the year must file even if:
    .....a) that person's income did not come from a trade or business conducted in the United States,
    .....b)that person did not have any income from U.S. sources, or
    .....c)that person's income is exempt from income tax.

  2. However, if that nonresident alien individual's only U.S. source income is wages in an amount less than the personal exemption amount (see Publication 501), you are not required to file.

  3. A nonresident alien individual not engaged in a trade or business in the United States with U.S. income on which the tax liability was not satisfied by the withholding of tax at the source.

  4. A representative or agent responsible for filing the return of an individual described in (1) or (2).

  5. A fiduciary for a nonresident alien estate or trust.

  6. A resident or domestic fiduciary, or other person, charged with the care of the person or property of a nonresident individual may be required to file an income tax return for that individual and pay the tax (Refer to Treas. Reg. 1.6012-3(b)).

my tax refund, help..!!!

this question has been asked a million time but my new question is if anyone else is having this trouble yet. i filed my taxes on 1/15 accepted on 1/17.where's my refund and the irs phone service are both drawing a blank with information on my refund’s called today and i was told mine is still being processed and this is as of 7:30am est and the only information the nice lady could give me was its still in processing and there was a letter generated on 1/20 but she don't know from witch department or why or any other information. anyone else had this happen yet and what could this letter be???just an extra piece of info on my 2007 tax return i forgot to file a w2 and got a letter in November telling me i owed $922 on that witch i mailed back stating to take it out this year’s taxes mailed that on 1/10 could this be the letter mailed telling me they are taking that?
