Filing 540x California amendment form :

For 2010 i have filed my CA returns as resident i.e. 540
and now i want to change my CA filing to CA
non resident i.e 540NR . ( i have my W2 from other state
as proof to show that i have stayed in CA for part year)

below are my questions :
1. is this amendment possible ?
2. can i use 540x for the same ? or
3. do i need to use any other forms ?
4. Any suggestions ?

“1. is this amendment possible ?”-->Yes; you should file an amended return as soon as possible after you determine that your original return was filed incorrectly. Use Form 540X to correct your California personalincome tax return.

3. do i need to use any other forms ?”-->You can use CA 540X Form. When amending a return for a tax year 2010, you need to use the tax form, CA540NR and instructions for the tax year you are amending.
“4. Any suggestions ?”--->I am not sure, but if it turns out that you OWE taxes to CA, just mail a check with the Form CA 540X

Hi Wnhough,

Appreciated your help. I have few more questions:

In 540x instruction ; I see amendment for 540 R and I see amendment for 540 NR But I do not seen instructions for 540 R to 540 NR ? any suggestions on how to proceed further in filing this amendment ?

Currently i have my new 540NR filled and 540X filed as per amendment 540NR.
please let me know if this works ?

Hi Wnhough,

Thanks for providing links. I called CA FTB helpline phone number and they asked me to just file CA540-NR and on TOP they asked me to mention "Amended" in red ink and apart from that they also asked me to send a copy of w2s.

Please let me know if you have any suggestions. do think these will be sufficient ? or should i check with few other people?

“I called CA FTB helpline phone number and they asked me to just file CA540-NR”-->Though you are a nonresident alien, as long as CA is your home state( I mean you live and work in CA), then you need to file CA 540 just like a CA full year resident. However, if you are a part year resident of CA, then you need to file CA 540NR as you said.

When filing your CA income tax return, it's important that you provide accurate information. An accurate tax return ensures that you pay all the taxes you owe or receive the full refund that you are due. It also protects you from prosecution in the event that your tax return is audited. Write your SSN or ITIN on all supporting documents.
