I am in the middle of a divorce process. I purchased a house in October 2009. This is the first time I have ever purchased a home in my name. My husband owned our house prior to us marrying, it has never been in my name.

I am trying to decide which credit I should be taking. If I take the homebuyers credit I have to supply 5 years of property tax, mortgage statements or homeowners insurance statements. We did not have a mortgage on our home, and the property tax and insurance statements are not in my name.

I can provide the documents needed for the first time home buyers credit, but not sure if I really qualify for this one.

I plan on filing head of household.
