Claiming of Dependents & Amended Tax Return Question

Hello,

Help, please.

I've been divorced since 2014. We are supposed to each claim one child as a dependent on our tax returns. I messed up last year and claimed both of the children as dependents on my 2016 return. (I know, don't ask. Still can't figure out how I did it! Lot of stuff going on, etc. One big Ugh which is really no excuse. Was probably gaming out different scenarios and then forgot to remove one dependent prior to filing). Anyhow, I do not receive alimony, only child support.

I offered to resolve the issue by allowing him to claim both dependents on his 2017 return. His tax preparer says that I must file an amended 2016 return. Is my solution acceptable? Thanks so much!

I think so; aslongas you allow your ex to calimbothof the dependents on your ex return then yes you need to file your 1040X due to the fact that both of you CANNNOT claim the same dependent( I mean the dependent that you also claimed on yur 2016 return) on your 2016 return at the same time since your ex also claims the dependent on his 2016 return.

Ex Still Hasn't Filed 2016...So he could...

My ex did not file his 2016 return yet. He could easily have his CPA do a minor adjustment to it removing the one dependent and file for 2016. Then he could claim both dependents for 2017 and file. I do not see why this solution wouldn't work.

As said previously, bothof you need to file 1040X for 2017,please contact an IRS Enrolled Agent/a CPA dong taxes in your local area for professional help for your fed/state returns
