Head of Household

I have a question that delves into the grey area of Head of Household.

My daughter and her daughter moved into an apartment with her boyfriend. She makes about 11k/year. He lives off military disability, and I have no idea how much he makes. When I asked the daughter, she said that he makes more than her. Nearly 100% of both their incomes go to "maintaining the household", rent, food, bills, etc.

I know the law says to claim HoH you have to pay over 50% of the household expenditures. Since his disability is contributing more than her pay check, I assume she's not able to claim? Or are his disability payments not included for some reason?
