Filing a very old California FTB original return.

Hello, I'm glad I found this site! I have a question regarding the filing of an old 90's return. My spouse and I were assessed as single (obviously) since no return was ever filed. Roughly four times the amount was collected via a levy for my spouse's account. The account was paid in full including all penalties and interest. Now they're coming after me.

Since California doesn't have a sol on unfiled returns , I felt it was best to go ahead and file a joint return. Needless to say, it reduced our tax liability greatly. It's been longer than four years since any overpayment, so, we're not looking for a refund.

Do any of the experts on here know if they must now accept the return and married filing jointly status? If they so, then shouldn't my balance zero out? So far, they havent sent it back or refused it! lol
