More Child Support Questions

I pay child support per a court order. However, the mother of the child is receiving Child Dependent/Welfare benefits from the State of NY. Can I claim my kid as a dependent since I canoot take a child support deduction?

I suggest that you refer to the Divorce Decree or Agreement, there should be a mention of whether or not you or your ex-spouse would be claiming the child as a dependent. Clearly, it makes sense for you to claim the child, but I would defer to the Legal document to assert your rights. Or simply check with your attorney as to the intent of the Divorce agreement.
