Regards dependent care flexible spending account FSA

Hi,
I put $5000 for the FSA last year and I have been reimbursed almost with that. I just find today that I am not eligible for that as my wife is not working. However she was always trying to find a job. Now what I should do to get these $5000 be taxed. I am afraid that I have to pay all the $5000.

Aside from that I have 2 kids. One of them has pdd+adhd. My wife has to take care of that kid by going to multiple therapies and services during the day so it is important to put the other kid in the daycare. Can this helps us to be eligible for this $5000?
