1099 misc. Do I have to claim this money from a lawsuit?

Hello, I recieved 70,000 on a sexual harrassment suit settled out of court, my attorney recieved 40% plus fees, I recieved approx. 38,000. I got a 1099 misc. form for the 70,000, do I have to claim this? I have been told know, that it was a non taxable income? Thanks for your help
