Question About Housing Tax Credit.

I hope you guys can help me figure out what to do.

In April of 2010 I bought a house, and had filed an extension for 2009 taxes.
Then I sent in all my paper work, and my settlement statement and filed my 2009 return.

A few months later, I got a letter saying they need more verification, so I sent them copy of my car registration, and a copy of my ID as requested, and then I finally got a form 4549, and I thought they just needed my signature, and I would get my money, it wasn't until a month later, when I called them, The a lady told I had waived away my tax credit with that form, And she said they were missing my settlement statement, and that the examiner, never looked in my original file for 2009, where it was. So I sent a letter to the reconsideration department explaining they messed up. and I never heard any thing back.

I want to know if I can try to refile for the tax credit on my 2010 tax return, and will it go through?
