Standard Mileage Deduction - Title No in Name

Been using the standard mileage deduction for business expense on 1040, Schedule C. Found out title is not in TP name. Fiance purchased car as gift. TP pays all expenses relating to auto.

Do amended returns need to be filed? Fiance has car for her use. Shared living expenses (live together) have children together.

Based on what you mentioned, it appears that you claimed the standard mileage deduction based on the miles that you drove and furthermore, you claim that you did in fact pay for the car gas and maintenance expenses whilst you were driving the car. I am assuming that the mileage rate resulted in a greater auto deduction than the actual expenses.

This would appear reasonable as far as the IRS would be concerned and I would not amend the tax returns. However, I would maintain a record of the mileage log, along with actual expenses that you did in fact pay that were related to the use of that auto vehicle.
