401k Foreign resident

Hi,
I got transferred from a US company to its foreign subsidiary. However that required termination of employment in US and new employment with the subsidiary in the new country. Since I'm no longer a US employee, I was trying to rollover my 401k to IRA, however was told that per IRS rules I'm still considered an employee of the parent company hence can't transfer funds to IRA. Is this true? Can someone point me to an IRS publication. I could not find anything on IRS website on this subject. Thanks.
