How does a taxpayer determine whether or not he or she is required to file a Federal Income Tax return for 2010?

In order to determine whether or not a taxpayer is required to file a Federal Income Tax return for 2010, they need to determine whether or not the following questions apply to them as shown below;

1. Did the Taxpayer have any Federal taxes withheld from pension and wages for this tax year and wish to get a refund back?

2. Is the Taxpayer entitled to the Earned Income Tax Credit or received any Advance Earned Income Credit for this tax year?

3.Was the Taxpayer self-employed with earnings of more than $400.00?

4.Did the Taxpayer sell his or her home in 2010?

5.Will the Taxpayer owe any special tax on a qualified retirement plan (including an individual retirement account (IRA) or medical savings account (MSA)? The Taxpayer may owe tax if he or she:
  • Received an early distribution from a qualified plan.
  • Made excess contributions to their IRA or MSA.
  • Was born before July 1, 1939, and did not take the minimum required distribution from their qualified retirement plan.
  • Received a distribution in the excess of $160,000 from a qualified retirement plan.
6.Will the Taxpayer owe social security and Medicare tax on tips that were not reported to his or her employer?

7.Will the Taxpayer owe uncollected social security and Medicare or Railroad retirement (RRTA) tax on tips reported to his or her employer?

8.Will the Taxpayer be subject to Alternative Minimum Tax (AMT)?

9.Will the Taxpayer owe recapture tax?

10. Is the Taxpayer a church employee with income in wages of $108.28 or more from a church or qualified church-controlled organization that is exempt from employer social security or Medicare taxes?
