Early annuity withdrawal exception to 10% penalty

Hello,

My friend has been on workers compensation over a year. He took out an early retirement distribution to pay for monthly health premiums. Obviously he did not use all of this just to pay for that but also because his low source of workers compensation income. Would he still have to pay the 10% penalty?
