Misc Non Taxable Comp on W-2

Hi everyone,

I live in Maine and work in New Hampshire. Last year my tax preparer noticed something odd on my W-2. There was a line item under section 2(not box 2) that said "Less Misc. Non Taxable Comp." The amount listed next to that line item was subtracted from my Gross Pay for Federal Taxes but not State Taxes. He had no idea what this Misc Non Taxable Comp was so I asked my employer. They didn't know either and I never got an answer.

This year I'm having an accountant do my taxes and she questioned the Misc Non Taxable Comp too. I was able to figure out that it was my YTD total for my Dental Pretax and Medical Pretax. My accountant is saying that the amount in Box 1 of the W-2, which shows the taxable federal wages, is less than the amount in Box 16, which is taxable Maine wages. These numbers should be identical however the difference is the exact amount listed under "Misc Non Taxable Comp."

According to my accountant, my W-2 is wrong and I'm being taxed by the state for my Medical and Dental Pretax Deductions. I brought this to my employer's attention who then reached out to the payroll company.

My employers saying my W-2 is correct and my accountant is saying it's wrong. I don't know what to do. Any help would be greatly appreciated. Thanks in advance.

It looks too odd to me, can't give you a proper answer on how to act in such a case. Just what comes to my mind, your preparer ought to fill the forms from the templates, not the ones sent by an employer. For example, W-2 form https://fillable-form-w2.pdffiller.com/ can be found here, yet it's paid to fill or download to print
