Claim of Right for same year

Hi All,
Clearly I am new to the craziness of the IRS.

I received a Bonus of 10K (around 6.5K net) in May 2014. I left the job in Oct 2014, and the company asked for the bonus back (that same 6.5K).
No worries, I returned every penny that was asked from me.

Now I got my W2, and it shows the bonus as my income. Its bumping me into a new tax bracket. Should I fight with the company to send me a correct W2, so can I use the 10K as my Claim of right deduction, to increase my return.

I went to H&R block, and they had NO CLUE. Go figure.
