Question Poker Winnings as a Non American

I am a Swiss Citizen with a Student Visa in the USA. I play a lot of poker and make money doing so. Where do I pay my taxes? In the USA or at home? And, what percentage do I pay? Does the USA have a tax treaty with Switzerland that allows me to not pay any taxes here in the States?

Can I deduct my loses?

In the USA or at home? ===>>>>>>>>>I guess you are a nonresident of US, then, The lottery commissions will still with hold 25% for federal taxes but as non-resident, you would only have to pay 15% to the US government however in order to claim that 10% back from the US, you would need to have a SSN and to file a non-resident alien tax filing. Of course, your own government may want to tax you but fortunately, many countries such as Canada and the UK consider lottery winnings to be windfall income and hence exempt from income taxes. If you are considered a nonresident alien of the US for income tax purposes and you have to file a tax return, you must use Form 1040NR.




It is important to keep an accurate diary or similar record of your gambling winnings and losses. To deduct your losses, you must be able to provide receipts, tickets, statements or other records that show the amount of both your winnings and losses. Refer to Publication 529, Miscellaneous Deductions, for more information.
And, what percentage do I pay? Does the USA have a tax treaty with Switzerland that allows me to not pay any taxes here in the States? =========>>>>>>>>>I do not think so;you still need to pay tax on it to us and gets refund on us return. You may have to pay tax on it to your taxing authority in swiss and may claim tax paid to us on youe swiss return

Can I deduct my loses?=========>>>>>>sorry no; nonresident alien of the US cannot deduct gambling losses.IF YOU ARE A US resident for tax purposes then, you may deduct gambling losses only if you itemize deductions. However, the amount of losses you deduct may not be more than the amount of gambling income reported on your return. Claim your gambling losses on Form 1040, Sch A as an "Other Miscellaneous Deduction" (line 28) that is not subject to the 2% limit
