can i claim my fiance? what about his arrears?

Hi my name is Chelsea. I have lived w my fiance for 3 years and the last 7 months he's been out of work from 2 surgeries. He has 2 children from a previous relationship and has paid 2500 into child support for 2014 but owes 3500 in arrears from being out of work. The court ordered support includes half child care expenses and one childs full premium costs for health care. I found online he can't claim the new noncustodial tax but possible the earned income tax? He made about 6k working part time the months he did work(that includes the child support accounted for). I realize child support is tax free but is there a way I could claim him as a dependent since I did support him all year? And once he pays arrears back could he claim daycare payments since he's responsible for 50% of it?

In that circumstance, the noncustodial parent would qualify for the dependency exemption and therefore the Child Tax Credit /addtl child tax credit that is refundable.
