To file or not to file

Hi,

I have a sub s corporation that is incorporated in the state of Kansas. I no longer live there and non of the income this corporation receives is derived from Kansas sources. Do I still need to file a corporate state return in Kansas? I now live in Washington state.

To answer your question, unless you have formally withdrawn from Kansas State your Corporation would be required to file a Kansas State Corporation Tax Return. Therefore, I urge you to first formally withdraw from Kansas State.

I think most States would require you to generally file a certificate of withdrawal from that State, whenever you cease to do any transaction. But, your Corporation must "have an active status and all annual reports must be filed on a timely basis." There is a fee associated with the withdrawal process and that fee currently is $30 for a for Profit Corporation.

However, for the specific requirements for Kansas State, I suggest that you contact Kansas Secretary of State at the following telephone number (785) 296-4564 to ensure that you receive the correct answer.

Upon receiving a confirmation that your Corporation has formally withdrawn from Kansas, I do not think your Corporation would be required to file any future Kansas 'S' Corporation Tax Returns.
