Married, Wife Not Changed Of Status Yet With A Son

i AM MARRIED, MY WIFE IS FROM THE PHILIPPINES WITH A SON, BUT THEY HAVE NOT CHANGED THERE STATUS YET TO GET THEIR GREEN CARD. THEY CAN NOT GET THERE SSN"S TILL THEN. I FILED MY W-4 MARRIED WITH 5 EXEMPTIONS, NOW I WAS WONDERING HOW CAN I CLAIM THEM WITH SSN"S NUMBERS?

As long as you are married,
your filing statuse is either Married Filing Jointly or Married Filing Separately. You can file a joint return if your spouse agrees to be subject to US taxation of her world-wide income including her income in the Philippines.

as your spouse and child do not have an SSN she/the child needs an ITIN if you file a joint return or as she lives in the US. You need to attach a completed Form W-7 to your return along with copies of her proof of ID and mail the entire package to the address on the W-7. I guess you should allow about 14 weeks for processing. ALSO you need to put in “applied for” in her SSN field on 1040when filing your return. The IRS will process the ITIN application first, apply the ITIN to the return, and then process the return. She'll get a letter from the IRS advising her of her ITIN. Keep that letter as part of your permanent records. Use that ITIN until she receives an SSN.

however, you will need to file on paper instead of e-filing your return, as it will reject if e-filed without an SSN. As your spouse is a nonresident alien and you file a MFJ, your spouse must have either a SSN or an ITIN. To get an SSN for your spouse, apply at a social security office or US consulate. You must complete Form SS-5. You must also provide original or certified copies of documents to verify your spouse's age, identity, and citizenship. If your spouse is not eligible to get an SSN, he or she can file Form W-7 with the IRS to apply for an ITIN.

Thanks for the info you have given me. Now I ask does my wife's son fill out a W7 as also?

yes;Irs issues an ITIN to individuals who are not eligible to obtain social security number. so, ITIN is a tax processing number.

the child needs to/ may want to apply for an ITIN if the child needs to be claimed as a dependent on the income tax return;

I was wondering on the reason for submitting Form W7. My wife is willing to be taxed here and in the Philippines, I just need to know what rest do I mark on the reasons. Also for her Son, what fo I need to mark the reason for him.

Then, she needs to file form w7 as she needs her ITIN to report her US source income to IRS.As said, IRS issues ITINs to foreign nationals and others who have federal tax reporting or filing requirements and do not qualify for SSNs.Also I should say that a non-resident alien individual not eligible for an SSN, who is required to file a U.S. tax return only to claim a refund of tax under the provisions of a U.S. tax treaty, needs an ITIN. What I mean is that as she pays taxes to her motherland on her US source/ motherland source income, then she can claim her tax paid to thr e Philippines her return then she needs an ITN.

1040 or 1040A/1040EZ; as said, she needs to file form W7 for her ITIN if she wants to file US return jointly with you.

On my w4 I put down married and 5 deductions. Is that asking too much on taxe exemptions?
