No Healthcare Tax Penalty

I did not get health coverage last year, so I will have to pay the tax penalty this year. However, my husband had health coverage through his parents. I talked with a lady at the Health Marketplace and she told me to just make sure my husband and I file our taxes separately because then I am charged 1% of my income only, rather than 1% of both of our incomes. Is this true? If it is I will file separately, but if I have to pay 1% of both of incomes regardless if we file separately/together, then I'd rather file together and just pay one tax preparer fee. Please help. Thank you.
